These Terms of Use ("Terms") govern access to and use of the website availia.com (the "Site"), and all related services, products, and programs offered by AVAILIA TELEHELP PLLC ("Agency," "we," "us," or "our"), including online and in-person coaching, consulting, and digital or physical products.
By accessing or using the Site or the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site or the Services.
Section One: Description of Services and Disclaimer
1.1 Coaching and Consulting Services
The Agency provides professional coaching and consulting services to individuals, partners/couples, and families, delivered both online (via video or teleconference) and in-person at our physical location. These services are confidential, subject to the limitations outlined in Section 1.3 and the specific client agreement signed prior to your first session.
1.2 Professional Nature of Services
Coaching vs. Medical Advice: You acknowledge that coaching and consulting services are not a substitute for medical diagnosis, professional mental health care, or substance abuse treatment. We are not medical professionals unless explicitly stated and contracted as such. We do not diagnose, treat, or cure any mental health or medical condition as coaches or consultants, even if the particular coach or consultant is so qualified and licensed.
Results: The effectiveness of coaching and consulting is dependent on client participation, engagement, and dedication. We make no guarantees, representations, or warranties regarding the results you will achieve.
1.3 Confidentiality Limitations
While we commit to maintaining the confidentiality of all personal information shared during sessions, we are legally required to break confidentiality in certain situations, including, but not limited to:
Reasonable suspicion of harm to self or others.
Reasonable suspicion of abuse or neglect of a child, elderly person, or disabled person.
Pursuant to a court order or at times but not always a subpoena.

You understand and agree that AVAILIA TELEHELP PLLC provides coaching and educational services only, and all content provided on this Website is for informational and educational purposes. Your continued use of the Website constitutes acceptance of the full terms of the Professional Disclaimer.
Section Three: Payments, Purchases, and Refunds
3.1 Scheduling and Payment for Sessions
All sessions (online and in-person) must be scheduled and paid for in advance through the Site's designated scheduling and payment system. You agree to adhere to our cancellation and rescheduling policy, which is detailed on the Site's booking page.
3.2 Sale of Products
The Site offers three categories of purchasable items. All fees paid for Services (Coaching and Consulting Sessions) and Digital Products are final and NON-REFUNDABLE, except as explicitly noted below.
Physical Products: All sales of tangible products (e.g., books, journals) are final unless the product is defective upon receipt. Return and refund policies for defective goods are governed by our separate Shipping & Returns policy.
Digital Products (Self-Study Packages): This includes guided self-coaching programs, downloadable guides, and online courses. Due to the immediate and intangible nature of digital goods, all sales of digital products are final and non-refundable.
Services: Refunds for paid sessions are governed by our cancellation policy.
3.3 Pricing and Billing
We reserve the right to change prices for products and services at any time. Prices displayed on the Site are subject to change without notice.
Section Four: Client Account and Responsibility
4.1 Account Security
You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to immediately notify the Agency of any unauthorized use of your account.
4.2 Eligibility
By using the Site, you represent that you are at least 18 years of age or possess legal parental or guardian consent and are fully able and competent to enter into these Terms.
Section Five: Intellectual Property Rights (IP)
5.1 Agency Content
All content on the Site, including text, graphics, logos, trademarks, digital programs, self-study packages, and proprietary session materials, is the exclusive property of the Agency and is protected by copyright and intellectual property laws.
5.2 Limited License
Upon purchasing a digital product or self-study package, you are granted a non-exclusive, non-transferable, revocable license to use the content for your own personal, non-commercial use only. You may not copy, reproduce, distribute, or create derivative works from this content without express written permission from the Agency.
Section Six: Client Community Engagement and Confidentiality Risk
6.1 Assumption of Risk in Public Disclosure
The Site may, now or in the future, offer features that allow clients to engage in public or semi-public activities, such as commenting on blog posts, participating in forums, or otherwise making their identity and experiences known (collectively, "Community Engagement").
You acknowledge and agree that any information you choose to disclose through public of Community Engagement is done at your own risk.
6.2 Agency Liability for Public Disclosure
The Agency strongly advises clients to exercise caution regarding the disclosure of personal or sensitive information in any public forum. While community engagement can offer important peer support, it carries inherent risks to your privacy.
The Agency has no control over, and accepts no responsibility or liability for, the actions, information, or content of third parties with whom you choose to interact.
The Agency is not liable for any breach of confidentiality or privacy resulting from information voluntarily shared by you or by another client through Community Engagement features.
Your engagement in these activities is a choice to make information public and waives any expectation of professional confidentiality regarding that specifically disclosed information. The decision to engage, and the sole ethical and personal responsibility for any risk incurred, rests entirely with the Client.
Section Seven: Limitation of Liability and Indemnification
7.1 Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall the Agency, its employees, directors, or contractors be liable for any indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, your access to or use of the Site or the Services.
7.2 Indemnification
You agree to indemnify, defend, and hold harmless the Agency from and against all losses, expenses, damages, and costs (including reasonable attorneys’ fees) resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the Site using your account.
Section Eight: Termination
We may terminate or suspend your access to the Site and the Services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. Upon termination, your right to use the Site will cease immediately.
Section Nine: Governing Law and Severability
These Terms shall be governed by and construed in accordance with the laws of the state of Washington State, without regard to its conflict of law provisions. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
